Injured Sikhs arrested by Patiala police from Rajindra hospital

http://www.sikhsiyasat.net/2012/03/31/another-injured-sikh-arrested-by-patiala-police-from-rajindra-hospital/
Patiala, Punjab (March 31, 2012): As per information available with Sikh Siyasat, Paramjeet Singh, fourth Sikh who was injured during clash at Arya Samaj area of Patiala, is also removed from Rajindra Hospital by Patiala police. Reliable sources revealed that Paramjeet Singh got discharged from hospital by the Police and was immediately arrested from the Hospital premiss yesterday evening.

Police did not filed his arrest in records till this evening. It is said that police was busy in maintaining security arrangements in wake of Navratre Shobha Yatra in city therefore “paperwork” was delayed. It is notable that as per Criminal Procedure code and Supreme Court of India rulings this delay amounts to violation of due procedure and fundamental right of “life and liberty” of the detainee.

It is notable that on March 28, during Punjab bandh (shut-down) altercation between Sikhs protesting against death sentence of Bhai Balwant Singh Rajoana and activists of Hindu right wing Shiv Sena turned violent. Police had restored to immense cane-charge on Sikhs. Four Sikhs, namely Paramjeet Singh, Karanpreet Singh, Tejbir Singh and Tejdeep Singh received massive injuries. Paramjeet Singh’s condition was critical on March 28. Police registered a case u/s 307, 353, 144 and some other sections of IPC.

The police removed Karanpreet Singh, Tejbir Singh and Tejdeep Singh from emergency ward of Rajindra hospital on March 28 and they were kept in CIA staff police station, Patiala. Karanpreet Singh and Tejbir Singh were able to secure bail, while Tejdeep Singh is still in jail.
Yesterday (March 30) the police arrested Paramjeet Singh from Rajindra Hospital Patiala and he is in the custody of Patiala Police.

Balwant Singh Rajoana case is about the rule of law in India

http://fullcomment.nationalpost.com/2012/03/30/counterpoint-balwant-singh-rajoana-case-is-about-the-rule-of-law-in-india/

The following was authored by a concerned Canadian Sikh academic, who wrote under the condition of anonymity, in rebuttal to Jonathan Kay’s piece, entitled “Why are some Canadian Sikhs expressing solidarity with an unrepentant terrorist?

There are many questions surrounding the stay of execution of of Balwant Singh Rajoana, who was sentenced for his involvement in the 1995 assassination of Beant Singh — the former chief minister of Punjab who spear headed the genocide against Sikhs in the region. But Rajoana’s sentence has since been stayed.

Beant Singh gave police officers the authority to carry-out extrajudicial executions, targeting and killing civilian Sikhs on the spot. This led to fake “encounter” killings, illegal detention, torture and rape. Beginning in 1984, and continuing until his assassination, an estimated 9,000-30,000 Sikhs were murdered in Punjab. During Beant Singh’s reign, thousands of Sikhs were killed for being “suspicious,” despite claims that there were only approximately 300 armed Nationalist Sikhs. After the death of Beant Singh in 1995, the senseless murders of Sikhs stopped.

Why is the Sikh population displaying insurmountable support and rallying to stop the execution of Rajoana, who many consider a terrorist? The fact of the matter is that Sikhs do not support terrorists or terrorism, but are looking for equal treatment and justice in the so-called secular democracy known as India.

Sikhs and Muslims are minorities in India and are often jailed without a court hearing, not allowed to fight their cases, given more severe penalties than their non-Sikh inmates, and given longer jail terms and intentionally delayed sentences.

In 1984, tens of thousands of Sikhs were killed in riots in Delhi that were believed to be led by accused Indian politicians Kumar and Tytler, but due to “technicalities,” their cases have been stayed. These riots happened almost 30 years ago, but these people are allowed to walk free. In 2003, accused politician Modi, started riots that led to the killings of thousands of Muslims in Gujarat. To this day, he walks free.

The minority Sikhs have long been oppressed by the Indian government. Corruption and discrimination have plagued Rajoana’s case and, as a result, there has been an outcry for justice. It is often said that there is no justice for Sikh prisoners in India. By displaying their support for Rajoana, Sikhs are expressing their desire that a single standard be applied to all people in India. Rajoana has always accepted responsibility for his crime and refused an appeal. He accepts the death penalty. People are simply arguing that the government should not hang Rajoana, until they hang other people who have committed similar crimes — to show the same commitment to human rights and the rule of law when the Indian state, its forces, its bureaucrats and its politicians commit heinous crimes against humanity.

The inconsistencies are too harsh to ignore. Kishori Lal, the “Butcher of Trilokpuri,” was released following three death sentences for going on a Sikh murdering spree in 1984. Today, many police officers and politicians who committed human rights violations and were involved in the Sikh genocide live freely and have worked their way up the political ladder. It appears the only fate for a Sikh political prisoner is the hangman’s noose.

There are numerous other legitimate reasons why Rajoana should not be executed:
  • There are 2 other Sikh men who were involved in the killing, their trials are still pending (conveniently still in jail and awaiting fair trial for 17 years). So how can one man be hung when the other cases are not officially over.
  • There is an ongoing explosives case on Rajoana in Patiala Court; the Advocate General can issue a writ to the court to suspend the hanging until the pending case is solved.
  • Rajoana was not the actual murderer of Beant Singh (the murderer died in the bombing); he was a conspirator. So why is he being executed after spending 17 years in jail?
You must ask yourself, are these these actions consistent with the values of a liberal democracy? Would you not be upset? This is precisely why the Sikh population around the world is joining hands and supporting Rajoana. To us, Rajoana is a freedom fighter whose intent was not to kill innocents, but rather criminals, and to bring justice to Punjab. If someone had successfully killed Hitler, would that man be considered a terrorist? Maybe by Hitler supporters.
When All Hopes of addressing a wrong had failed, Rajoana was left with no alternative. He did what the Indian government failed, or chose not, to do: He stopped the violence in Punjab! Rajoana and others took matters into their own hands, took down a tyrant and allowed the state of Punjab to live in peace. If you wish to try Rajoana and hang him, you must hand down the same sentence to the many other men who murdered Sikhs in cold blood. I am a Sikh and we do not support terrorism.
The Sikhs of Canada and around the world support Rajoana for ridding the world of an evil man. The population would not be opposed to the death penalty handed out to Rajoana, had the others been tried just as equally.

Update on Supreme Court Proceedings

New Delhi, Fri, 30 Mar 2012

The Supreme Court of India Friday dismissed the plea of a NGO seeking clemency for Balwant Singh Rajoana, who is on death sentence and his execution is scheduled on March 31, 2012.

Rejecting the plea, a bench of two justices - Justices T.S. Thakur and Gyan Sudha Misra said it could not pass any direction, as Rajoana has not filed any petition before it. In this matter the apex court asked how, in a criminal matter, could a person other than the accused move the higher court seeking relief against the award of a sentence.

Ramakrishna had filled the petition under Article 32. According to law, only a person whose fundamental right is violated could invoke Article 32.

The court also noted that there was no pressing situation as the government had already put on hold the implementation of Rajoana's death sentence.

As it is known that Rajoana was not interested in seeking clemency for him and he had earlier forbade Akali Dal for seeking it.

In a letter, which Rajoana had written to Akali Dal, said that Akali Dal for pushing for his mercy due to having fear that it may loose supports of Sikhs in the state. Rajoana has slammed the Party for not fighting for Sikhs? right who were slain in 1984 anti-sikh riots.

The bench also said that petitioner Abhinav Ramakrishna, an advocate, has no locus standi to plead on Rajoana's behalf.

However, bench has allowed to NGO (Lawyers for Human Rights International) to withdraw its petition filed with a similar plea.

The rejection of plea has ended the hope of several sikh groups who were demanding mercy for Rajona, a convict for killing erstwhile Chief Minister of Punjab Beant Singh in 1995.

The kin of Beant Singh too have reportedly forgiven Rajoana.

Rajoana was one of the main conspires of Beant Singh murder case where he served as a back-up bomb in case Dilawar, the main suicide bomb failed.

The main suicide bomber was dead on the spot in his self-explosion. Beant Singh and other 17 were also killed in the bomb blast.

Jagatar Singh Hawara, the mastermind of this blast was also in the jail who was on earlier death sentence but later his death sentence was converted into life time imprisonment when he filled a mercy petition before the court.

Rumours of Hanging Tommorrow

There are a number of rumours and press articles about the Supreme Court refusing the clemancy issued by the President of India.

The situation is unclear, so an appeal of calm is made to the Worldwide Sikh Community until there is further information.

As per the press release of Press Information Bureau of Government Of India.....http://pib.nic.in/ne...spx?relid=81875..... the death sentence of Balwant Singh Rajoana has been temporarily stayed till the matter is decided by the President Of India on representations filed by SGPC and DSGPC for commutation of death sentence of Balwant Singh.

Police Claim Sikh Youth Committed Suicide

Sikh youth commits suicide in support of Rajoana?

A Sikh youth allegedly committed suicide apparently in support of Babbar Khalsa militant Balwant Singh Rajoana, a claim denied by police.

The deceased had been identified as Ranjit Singh Chaudhary of Ghula Cheeka town in neighbouring Haryana.

Police found a suicide note from the site where the body was recovered. The note allegedly said that he gave his life by hanging himself in the Tafajalpura locality near local bus stand last night and that he was part of a 21-member group formed to save Rajoana. Police also recovered some posters form the site, sources said.

Patiala SSP Gurpreet Singh Gill, however, denied that the youth committed suicide in support of clemency to Rajoana and said that though they had recovered the suicide note from the site, Chaudhary had been under depression for quite some time.

Times of India - "Rajoana had protested killings during 1991 polls"

Rajoana had protested killings during 1991 polls
I P Singh, TNN | Mar 30, 2012, 05.16AM IST

JALANDHAR: Balwant Singh Rajoana was against several acts of militant organizations, including killing of over two dozen candidates in the 1991 assembly elections, this comes out from letters written by him.

The election was countermanded by then chief election commissioner T N Seshan just 24 hours before the polling. The Congress had boycotted the election process.

In a letter to his sister Kamaldeep Kaur on September 6, 2009, Rajoana implied that some of the militant outfits and their leaders were working at the behest of Central government agencies and their actions ultimately went against Sikhs.

He wrote that when the Akali Dal dared to contest the 1991 election after expressing faith in the Constitution, the panthic committee, a conglomerate of various militant organizations, ordered its boycott. "Instead of contesting the elections, Akali leaders were got eliminated so that the Congress win could be ensured and Sikhs could be rendered leaderless by eliminating Sikh and Akali leaders", he wrote.

Rajoana had also criticized killings of innocent in Punjab during militancy days and held "agencies" behind some militant outfits responsible for it. "The agitation (launched by SAD and Sikhs) was for very genuine demands of Sikhs but then it became victim of lowly mechanizations of Delhi. Due to attack on religion --Operation Bluestar and anti-Sikh riots in Delhi -- the Sikh organizations were compelled to demand independence as their psyche was badly injured," he wrote.

"Initially, the sangharash (struggle) was not communal and Hindus and members of other communities did not have any fear of these youths but then agencies infiltrated, formed panthic committees and misled the militants and struggle," Rajoana said adding, "several actions were executed which would have created opposition to the struggle and incurred a bad name for it."

Rajoana criticized Shingar blast
In his letter on April 22, 2008, Rajoana had written then he had no doubt that the movement for Khalistan was being "controlled by the Congress and agencies." "Their job is to keep the name of this path alive but none should be allowed to progress on it. That is why Shingar cinema blast took place. I think that happenings like Shingar cinema have nothing to do with the Sikh struggle," he added.

Rajoana for sarv dharam
"I think that if sangharash has to be taken forward, we have to win the confidence of people of other religions and communities. All of them should feel secure in our ideology and should honour it. Our ideology should be of sarv dharam (accommodative to all religions), justice and human progress and should not be confined to gurdwaras," Rajoana said in his letter written around two-and-a-half years ago.

Gurdaspur/Patiala, Punjab (March 29, 2012): As per information available from various sources the police today opened fire on Sikhs who had gathered at a Gurudwara Sahib in Gurdaspur to prevent right wing Hindu organization Shiv Sena from burning effigy of Bhai Balwant Singh Rajoana, a Sikh political prisoner who is on death row.

“A youth was killed and another person injured when police allegedly fired to disperse a group of persons assembled near Ramgarhia Gurdwara on Tibri road in Gurdaspur this morning. Curfew was later clamped in the town in view of the tension” reports Hindustan Times.

Whereas Sikh Siyasat sources have told that Jaspal Singh (18) of Sidhwan Jamita village near Gurdaspur died on the spot, after he was shot at by Punjab police personnel and other Sikh youth died on his way to hospital. Both are said to be students of Beant College, Gurdaspur. Curfew is installed in Gurdaspur.

It is notable that Badal Government in Punjab has tighten it’s grip on Sikh organizations and Sikh leaders and more than two hundred arrested are reported to have been made so far. On the other hand Government is not doing any thing to prevent Hindu right wing organizations like Shiv Sena and it’s activists.

There are reports from Patiala, Phagwara, Gurdaspur and Amritsar that Shiv Sena activists tried to burn the effigy of Bhai Balwant Singh Rajoana and attacked Sikhs. The police has so far made arrests of Sikh youth only. More than twenty five Sikhs are taken into custody from Amritsar, who were trying to prevent Shiv sena activists to march towards Sri Darbar Sahib. Shiv Seniks had declared to burn the effigy of Bhai Balwant Singh near Darbar Sahib complex.

DNA Article - Ex-Punjab DGP KPS Gill flays Rajoana's clemency clamour

By
Ajay Bharadwaj | Place: Chandigarh | Agency: DNA

Former Punjab DGP KPS Gill, during whose tenure former chief minister Beant Singh was assassinated here in 1995, termed Punjab chief minister Parkash Singh Badal’s efforts for clemency to Balwant Singh Rajoana as “perversion of system”.
He said the Akali leaders had been compulsively mixing religion with politics at times to subvert the system. “One fails to find a distinction between the SGPC and the Akali government sometimes”, said the former super cop.
Justifying hanging of Balwant Singh, who has been convicted in the assassination case, Gill said it was a strange situation when the convict wanted to go to the gallows and the state government was going overboard to oppose it.
He recalled that Balwant Singh’s involvement in the bomb blast that killed Beant Singh, demonstrated that militants had penetrated the police force, which had otherwise, fought militancy tooth and nail.
